In its judgement of 10 March 2022, the ECJ delivered another decision on the German law on detention pending deportation in case C-519/20. In short, the case dealt with how detainees awaiting deportation are to be accommodated. The ECJ has provided guidelines for the accommodation of persons seeking protection who are to be deported. The most important point is that detainees awaiting deportation may not be housed in prison-like facilities. The federal government was thus emphatically reminded that it may not simply declare an emergency and in the course of this imprison people who have done nothing wrong together with criminals. read more
