Many third-country nationals from Ukraine are threatened with deportation, as they are only granted protection in Germany under certain conditions. Since September 1st, they have only been allowed to stay in Germany for 90 days without a residence permit. Refugee Councils and Pro Asyl demand equal treatment for all refugees from Ukraine. Also, the federal government has failed to inform about the new regulations in time, as probably not all affected persons have applied for a residence permit before the end of August and thus are now already living in Germany without status. read more

In April 2020, the UK and Greece signed a joint action plan aimed at reducing the flow of migrants, protecting the most vulnerable and improving the situation in the Greek islands. The primary aim of the UK is to prevent onward movements from Greece, and this agreement seems to be one of few signed with other EU countries after Brexit. Statewatch asked the Home Office and the Crown Prosecution Service (CPS) for several clarifications regarding, for example, the “returns to countries of mutual interests” as well as the number of UK vessels and staff deployed in the Aegean. Information in response has been provided and made public in this article. Statewatch denounces that although the information received “gives no indication of any connection between UK-Greece cooperation and the prosecution of refugees, it is worth noting that (...) Greek authorities have prosecuted numerous refugees on smuggling charges, as in the infamous case of the Samos Two.” read more

In light of the recent protests, Left Party leader Janine Wissler called for "uncomplicated asylum" for people fleeing mistreatment or death from Iran. So far, there is no deportation stop for Iranian asylum seekers, neither at federal nor at states level. In 2017, a court ruled that prosecution for violating dress codes was not asylum-related, but "prosecution for a general criminal offence of no political significance". read more

There’s no right to fast-track the deportation of Albanian asylum seekers after their arrival in the UK, the Home Office finally concedes. In August, the former home secretary signed a deal with the Albanian government to deport individuals arriving irregularly. This scheme provided for deporting individuals from Albania, disregarding their right to a fair hearing for asylum claims. Yet, this policy won’t be applied to Albanians, after being challenged by the charity Care4Calais. read more

Hungary’s asylum system violates EU law because it is designed to limit access to the case files for certain applicants as well as for their legal council, as asserted in the ruling from the European Court of Justice (ECJ). The court examined the case of an asylum applicant whose protection status as a refugee was removed by Hungarian authorities in 2019. Further, access to the case file was denied. The asylum seeker and their legal representatives didn’t have access to the file to prepare their defence, which is against the EU law. read more

More than 100 people who boarded a train to Italy, coming from two asylum-seeker centers in Slovenia, will face proceedings for trying to cross the border. They left on Tuesday night before officers found them. Some of the people on the move in Slovenia hope to move on towards wealthier countries in the EU, where they can find more opportunities. In June, Slovenia's new left-liberal government under Prime Minister Robert Golob announced it would take down its border fence (around 200 kilometers long) on the Croatian border by the end of the year. The plan is to monitor the border with drones and cameras instead. read more
