The question of extraterritoriality has found a very particular application in contexts of migration. More than any other global common challenge, migration inherently involves an element of non-territoriality: a migrant is by definition leaving the territory of their country of nationality or origin, and with it the original bearer of legal responsibility for the fulfillment of their human rights. After all, the fundamental principle in international law is territorial jurisdiction: states are responsible for the respect of human rights treaties on their territory. This renders the questions of which state has to fulfil human rights obligations while a migrant is on the move and to what extent very pressing ones. read more
