Kashar is 49 years old an native in Kashmir. He has been 17 months in Bosnia y Herzegovina and tried to reach a Shengenmember. He made it until Croatia 15 times alread, once even to Slovenia. Vieles von dem, was aktuell geschieht, erinnert an 1992 und 1993, als das Grundrecht auf Asyl in Deutschland geschleift wurde. Damals wurde offensiv das Grundgesetz geändert und Art. 16 – „politisch Verfolgte genießen Asylrecht“ – für die meisten Asylsuchenden unerreichbar gemacht. Heute soll ein ganzer Kontinent faktisch aus dem individuellen Asylrecht aussteigen. Allerdings fährt die EU dieses Mal eine Verschleierungstaktik. Der „New Pact“ ist ein kompliziertes Gesetzeswerk. Das Perfide daran: Der Kahlschlag an den Menschenrechten ist nicht sofort sichtbar, wie es der Eingriff in das deutsche Asylgrundrecht gewesen ist. Die Entrechtung ist in einem Paragraphendschungel aus Hunderten von Seiten versteckt. Die Wirkung ist dieselbe. Fliehende Menschen sollen möglichst keinen Zugang zum Flüchtlingsschutz in Europa bekommen. read more

In the early hours of a Sunday in late November, 16-year-old Jeancy Kimbenga tried to reach Europe for a third time. He was on one of three dinghies that landed on the Greek island of Lesbos that day from Turkey. On that occasion, as with his two previous attempts, Jeancy claims he was forcibly returned to Turkish waters. So-called pushbacks, without consideration of a migrant's individual circumstances and without any possibility of applying for asylum, are illegal under international human rights law.
