Sie wird monatlich aktualisiert und enthält Informationen zu den gestellten Asylanträgen, den Entscheidungen sowie zu den anhängigen Verfahren. Die Daten sind nach Herkunftsländern aufgeschlüsselt. Deutscher Bundestag, WD 2 - 3000 - 075/17: Rechtsfragen bei Seenotrettungseinsätzen innerhalb einer libyschen SAR-Zone im Mittelmeer
Mit der Ausweisung und Inanspruchnahme einer "Search and Rescue Zone" (SAR-Zone) von 74 nautischen Meilen sowie der Notifizierung einer nationalen Rettungsleitstelle gegenüber der zentralen Koordinierungsstelle in Rom nimmt Libyen, welches der SAR-Konvention 2016 beigetreten ist, grundsätzlich seine völkerrechtlichen Verpflichtungen aus dem Abkommen wahr.
In einem neuen Rechtsgutachten kommt der wissenschaftliche Dienst des Bundestags jedoch zu dem Schluss, dass das Verhalten Libyens dennoch rechtswidrig ist. Das Recht auf freie Schifffahrt gelte auch in den SAR-Zonen jenseits des Küstenmeers. Die Behinderung von Seenotrettungseinsätzen sei dort mithin nicht zulässig. Vielmehr überlagert die Pflicht zur Seenotrettung das Territorialprinzip. read more

Deutscher Bundestag WD 2 – 3000 – 068/17 Der italienische Verhaltenskodex für private Seenotretter im Mittelmeer Völker - , europa - und strafrechtliche Aspekte
Das Gutachten des wissenschaftlichen Dienst des Bundestags weist darauf hin, dass der italienische Verhaltenskodex völkerrechtswidrig ist. Das Gutachten unterstreicht die völkerrechtliche Pflicht aller EU-Staaten, bei der Rettung von Menschen aus Seenot zusammenzuarbeiten und auch Hilfe leistenden zivilen Schiffen einen Nothafen anzubieten. Italien dürfe den Zugang zu Nothäfen mithin nicht einfach verweigern. read more

Still Moving Europe - Resistance Along The Balkanroute
It was not by accident that we chose ‘Moving Europe’ two years ago as the name for another project of support along the Balkan route. In summer 2015, we did not expect such a long and intensive struggle able to break the border regime, and in the same winter we could likewise not imagine such a quick and strong ‘roll back’ of the regime in 2016.
The texts and articles of the various groups and friends along the Balkan route are some of the main elements of this brochure. In addition, the brochure offers a detailed chronology of 2015 and 2016, in-depth insights from friends in Thessaloniki, and different voices from involved refugees and migrants. read more

The EU-Turkey statement – which the German Chancellor Angela Merkel had pushed for – was celebrated as a “European solution”, supposedly opposing nationalist and isolationist policies and at the same time “solving” the so-called “refugee crisis”. When the Balkan route was closed and the deal with Erdoğan concluded, the German interior minister de Maizière proudly explained in an interview: „The Balkan Route is finished and shall stay finished. (…) All‘ s well that end‘ s well.“ However, since the deal was concluded, the crisis for refugees trapped on the Greek islands dramatically deteriorated. Directly after the EU-Turkey deal was enforced, refugees arriving on Lesvos Island were locked into the camp Moria without any possibility to leave. read more

The EU-Turkey Refugee Deal and the Not Quite Closed Balkan Route
In March 2016, two measures ended what has been
labeled the European refugee crisis – the closure
of the so-called Balkan route and the agreement on
the EU-Turkey statement. The EU’s shift in policy
put an end to the Eastern Mediterranean migration
route into the EU, but it did not result in a complete
closure of the Balkan route.

BLAMING THE RESCUERS
CRIMINALISING SOLIDARITY, RE-ENFORCING DETERRENCE. Aiming to deter migrants from crossing the Mediterranean, the EU and its member states pulled back from rescue at sea at the end of 2014, leading to record numbers of deaths. Non-governmental organisations (NGOs) were forced to deploy their own rescue missions in a desperate attempt to fill this gap and reduce casualties. Today, NGOs are under attack, wrongly accused of ‘colluding with smugglers’, ‘constituting a pull-factor’ and ultimately endangering migrants. This report refutes these accusations through empirical analysis. It is written to avert a looming catastrophe: if NGOs are forced to stop or reduce their operations, many more lives will be lost to the sea.

Weitergabe von Aufklärungsdaten an Grenzbehörden in Libyen, Ägypten, Tunesien und Algerien
Der Bundesregierung liegen Lageberichte von FRONTEX vor, wonach Schleuser auf dem Mittelmeer libysche Polizeiuniformen getragen haben. Die Grenzagentur hatte bereits vor über einem Jahr geschrieben, dass sich das Schleusergeschäft in Libyen fest in der Hand von Angehörigen des Militärs und der Polizei befindet.Aus Befragungen von Migrant/innen erfuhr FRONTEX nach eigenen Angaben, dass Schleuser "Uniformteile" libyscher Sicherheitskräfte tragen. Bereits vor zwei Jahren hatte FRONTEX berichtet, dass die libyschen Schleusernetzwerke von aktiven oder ehemaligen Angehörigen der Polizei und des Militärs angeführt werden. read more
