In December 2021, the European Commission has proposed an asylum reform that allows Member States to suppress their responsibilities under EU asylum law in situations of “instrumentalisation” of migration. Several NGOs are strongly opposing this reform, because it is disproportionate, counterproductive, unnecessary, misguided and unfair to applicants and some Member States. The derogations allowed by this proposal are “substantial and substantive, significantly affecting the rights of people seeking protection,” as explained in the joint statement. Further, the NGOs warn that such a reform, allowing for derogations in various circumstances, may well undermine respect for the EU law as a whole, as well as set a precedent – not only within Europe but worldwide, subverting the global protection system. read more

The two countries have signed a joint statement on bilateral cooperation, and are considering “the establishment of a program through which spontaneous asylum seekers arriving in Denmark may be transferred to Rwanda for consideration of their asylum applications." According to the Danish immigration minister, about 1,000 asylum seekers per year may be transferred under this scheme. The new agreement was presented in Rwanda on Friday (September 9), but the idea of establishing asylum reception centers outside Europe has already been proposed in 2018, and criticized by the European Commission for violating EU asylum rules. The UK is also planning to transfer asylum seekers to Rwanda. read more

Braverman’s approach has caused consternation among Home Office officials, whilst immigration experts call for “sufficient alternative safe routes to the UK” instead. Simultaneously, around 8,000 individuals crossed the Channel during August, the highest monthly total on record. The Tajikistan authorities are allegedly forcing Afghan refugees, some of whom have been granted asylum in other countries, to cross the border back into Afghanistan. In these recent round-ups, people are picked up off the street and their houses raided, according to reports from Tajikistan's Afghan refugee community. According to The Guardian, citing Afghans in Tajikistan, the numbers of people being forced back “is running into the hundreds, with forced deportations increasing over the past fortnight.” read more

A group of asylum seekers was stranded on an islet on the Greek-Turkish border for weeks, until they were finally rescued by the Greek police, who were allegedly unable to locate the group. The incident has raised questions regarding Greek authorities’ use of the EU-funded surveillance system: could the asylum-seekers have been rescued sooner, and did the Greek authorities know where the asylum-seekers were? An investigation by DW suggests that “a prompt rescue of the group could have been possible” considering the existent surveillance technologies, and contradicting police statements in that area and others. According to the Greek Civil Protection Minister, the Automated Border Surveillance System (ABSS) didn’t provide any information about the group and their location, but it has been successfully deployed in other occasions, such as the deterrence efforts to block 36,000 people from entering Greece through the Evros border, in August alone. read more
